Most commercial disputes result
from a breach of contract. Sometimes however,
the dispute is between members of the same company,
shareholders and/or directors and practical and
sensible advice is required.
There are many number of torts, for instance;
nuisance where someone is interfering with your
enjoyment of your land, trespass/boundary disputes
where someone has encroached on your land and
may be claiming adverse possession, negligence
where someone has not taken care and has caused
you loss (most likely professional negligence
by a solicitor, accountant, architect).
Building disputes can be between householders
and their builders or between sub contractors
and main contractors. If the latter there is an
obligation to use arbitration or adjudication
and you need to be well prepared to bring or respond
to these proceedings.
It is one thing getting a judgment against someone
but the next stage is to enforce that judgment.

of goods, placing a charge (like a mortgage) on
property, bankruptcy or winding up proceedings.
